Granting Certificate of construction activity capability class I, II

Individuals and organizations participating in construction activities must possess construction activity competency certificates with appropriate classes when participating in construction activity

Relevant legal documents:

- Decree No. 42/2017 / ND-CP dated April 5, 2017, of the Government amending and supplementing some articles of the Government's Decree No. 59/2015 / ND-CP dated June 18, 2015, on governance management of construction investment projects;

- Decree No. 100/2018 / ND-CP dated July 16, 2018, of the Government, amending, supplementing and annulling some regulations on business investment conditions in the fields of state management of the Ministry of Construction erect;

- Circular 03/2016 / TT-BXD dated 10/03/2016 of the Ministry of Construction on decentralization of construction works and guidelines for application in the management of construction investment activities;

- Circular 08/2018 / TT-BXD dated October 15, 2018, of the Ministry of Construction, guiding some contents on construction practice certificates, construction performance management, and contractor management certificates. in addition to construction activities in Vietnam.

Fields of operation must have a certificate of construction operating capability:

- Construction survey;

- Making construction planning;

- Designing and verifying work construction designs;

- Preparation and verification of construction investment projects;

- Project management consultancy;

- Construction works;

- Supervision of construction;

- Construction inspection;

- Managing construction investment costs.

General conditions for being granted a construction activity capability certificate:

- Having a business registration certificate or establishment decision of a competent agency according to the provisions of law;

- Individuals holding key positions must have a labor contract with the organization requesting construction activity certificate;

- In case of projects and constructions with specific characteristics such as nuclear power plants, factories producing toxic chemicals, explosive materials, Individuals who take key positions, apart from requirements must have a practice certificate corresponding to the type of work to be performed and professional skills in a specific field of the project.

Particular conditions for being granted a certificate of capacity of construction organizations of grades I and II:

Grade I:

- Individuals holding the position of commander of a construction site must satisfy the conditions of the commander of a construction site of grade I suitable to their professional fields;

- Individuals in charge of the construction of professional fields have a university or vocational college degree suitable to the job and the working time of at least three years for a university degree, five years for a vocational college degree;

- Technical workers perform jobs with diplomas or certificates of professional training following the contents of registration for granting capacity certificate;

- Ability to mobilize a sufficient number of major machinery and equipment to meet the requirements of the construction of works suitable to the jobs they undertake;

- Having direct performed work of main work item related to the content of the request for issue of a certificate of at least 01 Works from grade I or higher or 02 Works from level II or higher of the same type.

Grade II:

- Individuals holding the position of commander of a construction site must satisfy the conditions of the commander of a construction site of grade II suitable to their professional fields;

- Individuals in charge of the construction of professional fields have a university or vocational college degree suitable to the job and the working time of at least one year for a university degree, three years for a vocational college degree

- Technical workers perform jobs with diplomas or certificates of professional training following the contents of registration for granting capacity certificate;

- Ability to mobilize a sufficient number of major machinery and equipment to meet the requirements of the construction of works suitable to the jobs they undertake;

Certification procedure

1. Composition of record
- An application for a Certificate of construction activity capability made according to a set form;

- Notarized copy of Business Registration Certificate or Establishment Decision of the organization;

- A list of experience and attached to practice certificates and labor contracts of key labors made according to a set form;

- Copies of diplomas, certificates and labor contracts of key labors related to the content of the request for capacity certification;

- Economic contracts and acceptance records of completed works (at least 01 typical projects related to the content of construction capacity certificate);

2. Certification authority

- Ministry of Construction issues Class I capacity certificate;

- Department of Construction issues Class II capacity certificate.
